01 — Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and GenPlay ("we," "us" or "our"), concerning your access to and use of the GenPlay platform and AI generation services (collectively, the "Service"). By accessing the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service.

02 — Artificial Intelligence Services

A. Service Description

GenPlay utilizes advanced generative artificial intelligence technologies to assist in the creation, coding, and design of playable advertisements.

B. Generative Output & Accuracy

Use of our AI services may result in the generation of code, images, and interactive elements ("Output"). You acknowledge that:

  • Generative AI may produce incorrect, incomplete, or unexpected results. You are responsible for reviewing and testing all Output before deployment.
  • We do not guarantee that the Output will meet specific performance metrics or ad network compliance standards without manual adjustment.

03 — Intellectual Property Rights

A. Your Inputs

You retain all rights to the images, branding, and data you upload to the Service ("Input"). You represent and warrant that you have the necessary rights and permissions to use such Input.

B. Ownership of Output

Subject to your compliance with these Terms and full payment of applicable fees, GenPlay assigns to you all its right, title, and interest in and to the Output generated specifically for you. This means you own the playable ads you create.

C. Platform Rights

We retain all rights to the underlying platform, the pre-existing AI models, algorithms, and software used to generate the Output.

04 — Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Specifically, you agree not to:

  • Use the Service to generate malware, malicious code, or deceptive content.
  • Reverse engineer, decompile, or attempt to extract the source code or weights of our AI models.
  • Use the Service to infringe upon the intellectual property rights of others.
  • Generate content that is illegal, harassing, or promotes violence.

05 — Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
